CLENBUTOROL TESTING RULE BECOMES EFFECTIVE TODAY, 12/15/09

AS STATED IN PRIOR NOTICES AND ON OUR WEBSITE BLOG at WWW.NEWMEXICOHORSEMEN.COM,  the NMRC’s recently enacted rule to eliminate testing levels for Clenbuterol goes into effect today. Effectively, without any testing levels, the medication becomes a zero tolerance medication for racing purposes.

We have expressed our opposition to the decision by the NMRC to amend the rule on numerous occasions without success. We also retained counsel to review the steps that were taken to amend of the rule to determine what legal action if any could be taken in this matter. After consultation with several attorneys, we are advised that there is nothing that can be done in court and that the rule as amended by the NMRC must be followed.

A positive post race test for Clenbuterol (Class III medication) carries a mandatory loss of purse, $1,500 fine and a lengthy suspension.

If you have any questions regarding this notice, please call Pat Bingham at the NMHA office at 5050.266.7056 (Cell 505.205.6650) or Julian Luna, Executive Director for the New Mexico Racing Commission at 505.222.0702.

It's about time something is being done to stop all of the cheating that is going on here in New Mexico. It's not fair to the owners and trainers that follow the rules, not to mention how these drugs harm horses. Hopefully this is just the beginning, so we can get these drugs outlawed in horse racing and make it a level playing field for all owners and trainers involved in the sport.
